International Orders
We can ship internationally.
International Duties, Taxies, and Fees
International customers are responsible for all custom charges,
including taxes, duties, brokerage fees or handling charges. Your local Post
Office and/or government should be able to help with these charges.
Signature Required on Packages of $500 or more
A signature is required when the package is delivered (on all packages of greater than $500 in value), to ensure security and to prevent theft.
Alternate Shipping Address Policy
You may ship to an address other than your billing address, only if you have the shipping address listed as a "verified" alternate shipping address with your credit card company. You may experience delays otherwise. On orders over $500 we ship orders only to the billing address of the credit card.
Sales Tax
Sales tax is only
required for orders shipping within our resident state. Therefore, all orders
shipping within New Jersey will be charged the applicable sales tax.
Receiving Your Order
When you receive
your order, please follow these guidelines:
Upon receipt of your new
merchandise, please inspect it carefully as to contents and condition. All
claims for damaged or missing items MUST be reported to Browns Point Marine
Service within two (2)
business days of receipt of merchandise. In the event your package arrives
damaged, it is the responsibility of the customer to contact the carrier to
inspect the package to assure full refund/replacement. All packaging MUST be
retained until the problem has been resolved.
Carefully unpack and
inspect all merchandise. Please DO NOT damage the manufacturer's packaging. DO
NOT fill out the manufacturer's warranty cards until you are absolutely sure you
want to keep your merchandise. We cannot accept merchandise for return with
completed warranty cards of damaged or missing collateral material. Do not throw
away any of the packaging materials such as boxes, instructions, inserts, bags,
etc until you are completely sure you want to keep the equipment.

Money Back Guarantee - Refund
Policy
All items except
otherwise mentioned, may be returned within 15 days from the invoice date for a refund, excluding return shipping charges. All
items must be in original manufacturer condition. Items and packaging, boxes, manuals, etc must be in new/unopened condition.
Items can be returned for exchange or store credit within this period. A 20% restocking fee
will apply to all refunds. Refunds are issued back to the original source of the
purchase.
All returns are at Browns Point Marine Service's discretion.
Restocking Fee
A 20% restocking fee
will be applied to all returns for a refund. Shipping charges are
non-refundable. No returns after 15 days.
Security
Security is our number one priority. All on-line transactions are sent through
our secure server. Once the information is
received through the internet, trusted authorized employees will process your
payment, and make sure that your information is handled with the highest level
of security.
Processing Time
Browns Point Marine Service will try to process orders same-day, whenever possible.
Otherwise, you can expect your order to be processed within approximately two
to four business days, provided the items are in stock and there are no problems with
the payment verification. Browns Point Marine Service does not guarantee same day shipping.
Orders will not be processed on weekends and holidays.
Back Orders
Any items that are unavailable will be placed on back order, and the remainder
of your order will be held. Once we receive the backordered item(s), we will
ship your order as soon as possible. If you'd like a faster shipping method, contact us, and the price of your shipping will adjust accordingly.
Special Orders
We will gladly special order any product for you on a special order basis.
Special Orders must be pre-paid and cannot be cancelled at anytime for any
reason. Browns Point Marine Service will issue a refund only if the merchandise has not
shipped from the manufacturer and 30 calendar days have passed.
Order Status
Browns Point Marine Service will do everything possible to keep you informed of
your order via e-mail. Your tracking number will be emailed to you once the item
is shipped. You can also check your order status by clicking on "Check / Review Order" on the menu.
Privacy
Browns Point Marine Service respects your privacy. We will not under any circumstances
sell or release your information to anyone. All of the information obtained
from our web site will be used for processing purposes only. The only e-mail you
will receive from Browns Point Marine Service are updates to any recent orders.

Change Orders
You may request a change to your order, provided your order has not
already been charged. Please call during business hour to change your order.
Please always have your order number ready. Please
never request a change order via Email as we may not receive it in time.
Cancel Order
You may request a cancellation of your order, provided your order has not
already been processed and shipped. Please call during our business hours to
cancel your order. If your account has already been charged, you will receive a
credit back to your account minus a 10% restocking fee. Please never
request a cancel order via Email as we may not receive it in time.

We do offer wholesale discounts to the marine trade. In addition, Browns Point
Marine Service tries to offer the best possible price for you, and offers these
great discounts to all of our customers through our web site. Anytime we receive
any specials or promotions, we will immediately post them on our web site for
you, the customer, to take advantage of. If you are a company seeking wholesale

replace your personal product knowledge, experience and research. Suzuki Marine
does change part numbers, we reserve the right to update or change the part
number you ordered.

information contained in or referenced on our site. However, occasional human
error may occur and we therefore cannot guarantee that all product descriptions,
specifications, pricing or any other content on the site is entirely accurate,
complete, current, or that we are responsible for these errors. In the event
that a product is listed at an incorrect price due to typographical,
informational, technical or any other error, Browns Point Marine Service at its sole discretion
shall have the right to refuse or cancel any order for that product and

Browns Point Marine Service - Terms and Conditions
By accepting delivery of any
product delivered from Browns Point Marine Service ("Browns Point
Marine Service"), you ("Customer") agree to
be bound by the terms and conditions listed below. You and Browns Point
Marine Service agree
that the following terms and conditions are the exclusive terms governing
the sales transaction between Customer and Browns Point Marine Service. Any attempt to alter,
supplement, modify or amend these terms and conditions by the Customer will
be considered a material alteration of this agreement and, therefore, are
null and void. In addition, these terms and conditions are subject to change
at any time, without prior written notice. Therefore, please check these
terms and conditions carefully each time you place an order with or accept
delivery of any goods from Browns Point Marine Service.
1. Browns Point Marine Service SATISFACTION GUARANTEE - Browns Point
Marine Service offers our customers a 10-day satisfaction replacement or refund guarantee
on all purchases (with applicable restocking fee).
However, to take advantage of Browns Point Marine Service's
return guarantee policy, Customer agrees to comply with Browns Point Marine
Service's Product
Return Procedure as below. Any breach of Browns Point Marine Service's Return Policy Procedure
will result in the loss of Browns Point Marine Service's replacement/return guarantee.
Furthermore, all return shipments not in compliance with these instructions will
be rejected.
Product Return Procedure:
- No returns on any electrical items unless there is a warranty issue. See
warranties section below.
- To return a product based upon Browns Point Marine Service's
replacement/return guarantee, you must obtain a Return Merchandise
Authorization ("RMA") number within the guarantee return period for the
product (described above). Please contact us by telephone to receive an RMA
number. Browns Point Marine Service will not accept returns without prior authorization and a RMA number. Once issued, RMA numbers are valid for 10 days within which return
products must be received by Browns Point Marine Service. RMA numbers will not be extended or
reissued. Customer should prominently display the RMA number(s) on the
shipping label of boxes containing the returned product.
- Customer is solely responsible for shipping
any returned product to Browns Point Marine Service. Customer agrees to use only reputable
carriers capable of providing proof of delivery and insurance for the entire
value of the shipment. Customer agrees to bear all shipping charges and all
risk of loss for the return product during shipment. Customer agrees that all
returned products will be 100% complete, in re-saleable condition, and will
include the original packaging material, manuals, blank warranty cards, and
other accessories provided by the manufacturer. If any component of the
returned product is missing, Browns Point Marine Service's Return Procedure will be breached
and Browns Point Marine Service will reject the entire return or may choose to impose
additional charges against the customer for replacement of the missing
component.
- Browns Point Marine Service will not refund to Customer the
original shipping charges. In addition, Browns Point Marine Service will assess a
20%
restocking fee against the Customer's account on all returns for refund.
2. WARRANTIES
Browns Point Marine Service is a distributor only. Products sold by Browns Point
Marine Service are not
manufactured by Browns Point Marine Service. The products may, however, be covered by each
manufacturer's warranty, service, and support policy (if any). Browns Point
Marine Service assigns and passes through to the Customer any warranty of the
manufacturer, and Customer acknowledges that it shall have recourse only under
such warranties and only as against the manufacturer of the products. Browns
Point Marine Service MAKES NO
REPRESENTATION OR EXPRESS WARRANTY WITH RESPECT TO THE PRODUCT EXCEPT THOSE
STATED IN THIS DOCUMENT. Browns Point Marine Service DISCLAIMS ALL OTHER WARRANTIES,
EXPRESS OR IMPLIED, AS TO ANY SUCH PRODUCT, INCLUDING AND WITHOUT LIMITATION,
THE IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE,
AND ANY IMPLIED WARRANTIES ARISING FROM STATUTE, TRADE USAGE, COURSE OF DEALING,
OR COURSE OF PERFORMANCE.
3. LIMITATION OF LIABILITY
IN ALL CIRCUMSTANCES Browns Point Marine Service's MAXIMUM LIABILITY IS LIMITED TO THE PURCHASE
PRICE OF THE PRODUCTS SOLD. Browns Point Marine Service SHALL NOT, UNDER ANY CIRCUMSTANCES, BE
LIABLE UPON A CLAIM OR ACTION IN CONTRACT, TORT, INDEMNITY OR CONTRIBUTION, OR
OTHER CLAIMS RELATING TO THE PRODUCTS IT SELLS WHICH EXCEEDS THIS LIABILITY
LIMIT. Browns Point Marine Service SHALL NOT BE LIABLE FOR THIRD PARTY CLAIMS FOR DAMAGES
AGAINST THE CUSTOMER, OR FOR MALFUNCTION, DELAYS, INTERRUPTION OF SERVICE, LOSS
OF BUSINESS, LOSS OR DAMAGE TO EXEMPLARY DAMAGES, WHETHER OR NOT Browns Point
Marine Service IS
APPRISED OF THE POSSIBILITY OF SUCH CLAIMS OR DAMAGES.
4. GENERAL TERMS AND CONDITIONS
Payment Terms; Orders: An order is not binding upon Browns Point Marine Service until it is
accepted; Browns Point Marine Service must receive payment before it will accept an order.
Payment for product(s) ordered is due prior to shipment. Customer can make
payment by credit card, or some other method prearranged with Browns Point
Marine Service. You
agree to pay the amount(s) due as specified on the invoice, and you agree to pay
interest on all past-due sums at a rate of 1.5% per month or the highest rate
allowed by law, whichever is greater.
Shipping Charges: Your total cost for purchase of any product will
include shipping and handling charges shown on the Browns Point Marine Service invoice.
Title; Risk of Loss: Browns Point Marine Service will arrange for shipment of ordered product(s) to the Customer
as selected by the Customer, meaning title
to the product(s) -- excepting software-- and risk of loss passes to the
Customer upon delivery to the carrier. Browns Point Marine Service reserves a purchase money
security interest in the product(s) until its receipt of the full amount due.
Customer agrees to allow Browns Point Marine Service to sign appropriate documents on Customer's
behalf to permit Browns Point Marine Service to protect its purchase money security interest.
Title to software will remain with the licensor(s). All software is provided
subject to the license agreement of the software maker. Customer agrees to be
bound by any software license agreement once the seal on the package is broken.
Browns Point Marine Service will advise Customer of estimated shipping dates, but
Browns Point Marine Service
will, under no circumstances, be responsible for delays in delivery, and
associated damages, due to events beyond its reasonable control, including
without limitation, acts of God or public enemy, acts of federal, state or local
government, fire, floods, civil disobedience, strikes, lockouts, and freight
embargoes. All products are shipped fully insured and any claims of loss or
damage must be reported to the Shipping Carrier. Insurance claims for some
Shipping Carriers may require as much as 45 days before a claim for loss can be
flied.
Governing Law and Jurisdiction: Any dispute arising out of or related to
these Terms and Conditions or the sales transaction between Browns Point Marine
Service and
Customer shall be governed by the laws of the State of New Jersey, without regard
to its conflicts of law rules. Specifically, the validity, interpretation, and
performance of this agreement shall not be governed by the United Nations
Convention on the International Sale of Goods. Browns Point Marine Service and Customer consent
to the exclusive jurisdiction and the venue of the State Courts of the State of
New Jersey, Middlesex County, to resolve any dispute between them related hereto,
and the parities waive all rights to contest this exclusive jurisdiction and
venue of such Courts. Finally, the Customer also agree not to bring any legal
action, based upon any legal theory including contract, tort, equity or
otherwise, against Browns Point Marine Service that is more than one year after the date of the
applicable invoice.
Severability: If any provision contained in this agreement is or becomes
invalid, illegal, or unenforceable in whole or in part, such invalidity,
illegality, or unenforceability shall not affect the remaining provisions and
portions of this agreement, and the invalid, illegal, or unenforceable provision
shall be deemed modified so as to have the most similar result that is valid and
enforceable under applicable New Jersey law.
Waiver: The failure of either party to require performance by the other
party of any provision of this agreement shall not affect in any way the first
party's right to require such performance at any time thereafter. Any waiver by
either party of a breach of any provision in this agreement shall not be taken
or held by the other party to be a continuing waiver of that provision unless
such waiver is made in writing.
Entire Agreement: These terms and conditions, together with the Browns
Point Marine Service's invoice respecting the products ordered by Customer, are the complete
and exclusive agreement between Browns Point Marine Service and Customer, and they supersede all
prior or contemporaneous proposals, oral or written, understandings,
representations, conditions, warranties, and all other communications between
Browns Point Marine Service and Customer relating to the subject products. This agreement may
not be explained or supplemented by any prior course of dealings or trade by
custom or usage.
